Since March 6th of this year the exchange is operated by Tibanne Co, Ltd., a Japanese company.
It is unclear if the exchange is registered as a Financial Instruments Firm with the Japanese regulator Kanto Local Finance Bureau (Ministry of Finance). The firm’s website lists Mutum Sigillum, LLC of Delaware as a subsidiary and that is the name associated with the Dwolla account provided to those in the U.S. for moving funds to and from the exchange.
In the exchange’s forum post was mention that it was “working with different lawyers in different places” though no specifics were provided.
The exchange recently had suffered outages related to distributed denial-of-service (DDoS) attacks though the service’s subsequent relocation to a network with better protections seems to have silenced those attacks. There were periods of time measured in hours where access to the trading site was not possible. During those times not only were no trades occurring but access to the funds held by the exchange was blocked as well.
